Scope of Employment Laws in Azerbaijan

Article 5.1A of the Labor Code of Azerbaijan declares that the labor laws hold their jurisdiction over the following categories of individuals. 

  • Citizens of the country
  • Foreign employees working in Azerbaijan 
  • Stateless persons
  • Stateless persons who have received a special permit to do business in Azerbaijan 

Azerbaijan Employment Laws for Azerbaijani Employees Working Abroad

Azerbaijan’s employment laws are also applicable to nationals who’re working outside the country. However, the scope is restricted to some professionals only. Here are the conditions when the country’s laws are applicable to an Azerbaijan national working abroad.

  • He/she working in Azerbaijani embassies abroad 
  • He/she is working in the country’s consulates outside Azerbaijan are help 
  • he/she is employed on a ship (with an Azerbaijani flag) in international waters

Important Employment Rules in Azerbaijan

Here are some important labor laws and employment rules mentioned in the Labor Code in Azerbaijan.

1. Segregation of Workers in Azerbaijan

The labor laws in Azerbaijan classify its working population into 2 categories - employees and freelancers. 

  • Employee

Under the system, an employee is an individual who is working under an employment contract. he/she is committed to the company for the long term and receives work on a regular basis. All the employees are entitled to statutory employment rights defined under Azerbaijan’s labor laws.

  • Freelancer/Contractor

A freelancer or a contractor is an individual who provides services to registered, legal entities in accordance with a Civil Code. he/she may or may not be obligated to stay with the company for long-term and companies pay them a set amount for their work. They work on a contractual basis and charge as per the type of service rendered. 

Freelancers and contractors are not entitled to statutory employment rights in Azerbaijan

2. Maximum Number of Working Hours

Every country defines the maximum number of hours that an employee can work in an organization. This time period is calculated through the Production Calendar under the supervision of the Ministry of Labour and Social Protection of the Population. The country defines this period to prevent exploitation of employees as the employer can’t engage employees more than the time period specified by the MLSPP. 

In 2022, the maximum working hours are set to 8 hours/day and 40 hours/week. There will be working for 5 days a week and will get 2 days off. According to the Azerbaijan Resolution, there would be 241 working days in 2022.

3. Laws on Employee’s Background Check

According to Azerbaijan’s Labor Code, the employer has a complete right to question the applicant about his background, past, health, criminal records, etc. however, he can’t ask for any other document except those listed in the Labor Code. 

4. Work Permission

According to the Migration Code, you need to seek permission to work from the government of Azerbaijan if you’re a foreign individual or a stateless person. This permission will be in the form of an employment visa (which allows you to stay and work in Azerbaijan). Also, they can reapply for a visa if their existing visa has expired. 

You can also opt for an Azerbaijan work visa, which is valid for 90 days, or a business visa with a validity of 180 days. Here are the documents that you’ll need.

  • Passport/border-crossing document
  • Passport-size photographs 
  • Medical insurance policy
  • Receipt of visa fee payment 
  • Other documents under Articles 25 to 34, Migration Code

5. Residence Permit

It is mandatory for every foreign employee to apply for a temporary residence permit to stay in Azerbaijan. The documents you are required to submit for a residence permit are listed in Article 46 of the Migration Code.

6. Age Limit

The maximum working age in public institutions in Azerbaijan is 65 years. This age limit is extendable by up to 5 years on agreement by the executive authority. There is no age limit in the private sector.
